which includes computer software components and may include associated media,
printed materials, and "online" or electronic documentation ("SOFTWARE").
By installing, copying, or otherwise using the SOFTWARE, you agree to be bound
by the terms of this EULA. If you do not agree to the terms of this EULA,
do not install or use the SOFTWARE.
SOFTWARE LICENSE
The SOFTWARE is protected by copyright laws and international copyright
treaties, as well as other intellectual property laws and treaties.
The SOFTWARE is distributed as try-before-you-buy. This means:
1. All copyrights to SOFTWARE are exclusively owned by MiningTools.net.
2. Anyone may use this software during a trial period of 30 days. Following
this trial period of 30 days or less, if you wish to continue to use
the SOFTWARE, you MUST register.
3. Once registered, the user is granted a non-exclusive license to use the
SOFTWARE on one computer, for any legal purpose, at a time. You may
not rent, lease, or lend the SOFTWARE. You may permanently transfer
all of your rights under this EULA, provided you retain no copies, you
transfer all of the SOFTWARE (including all component parts, the media
and printed materials, any upgrades, this EULA, and, if applicable,
the Certificate of Authenticity), and the recipient agrees to the terms of
this EULA. If the SOFTWARE is an upgrade, any transfer must include
all prior versions of the SOFTWARE.
4. The SOFTWARE unregistered trial version may be freely distributed,
with exceptions noted below, provided the distribution package is not
modified. No person or company may charge a fee for the distribution of
the SOFTWARE without written permission from the copyright holder.
The SOFTWARE unregistered trial version may not be bundled or distributed
with any other package without written permission of the copyright holder.
6. Standard One Server License. You may receive the SOFTWARE in more than one
medium. Regardless of the type or size of medium you receive, you may
use only one medium that is appropriate for your single computer.
You may not use or install the other medium on another computer. You may
not loan, rent, lease, or otherwise transfer the other medium to another
user, except as part of the permanent transfer (as provided above)
of the SOFTWARE.
7. Site License. A site license allows usage of this program on multiple
computers by multiple users within the limitations of a single company's
site location. A site location is defined by the physical location of
the purchasing site and other company locations within a 100-mile radius.
This limitation is further enforced by the requirement that all developers
share an email domain (i.e. peter@miningtools.net, kate@miningtools.net).
8. Educational and Non-profit Organizations One Server License ("Academic
License"). MiningTools.net offers qualified educational institutions,
non-profit organizations and students the opportunity to buy the Academic
License for learning, administrative or educational instruction purposes.
Academic version of the SOFTWARE cannot be used for any commercial
purpose. A commercial purpose is any revenue-generating activity beyond
the usual and customary activities educational institutions and nonprofits
engage in.
9. Distribution of Keys. Registration/Unlock Keys must not be distributed
to any person, organization, newsgroup etc except the purchaser of
the product. In the case of site license, only those users currently
working at purchasing site location. It is a violation of this EULA
agreement to distribute Registration/Unlock Keys and will result in
termination of EULA and deactivation of key if it is determined that
keys were wilfully distributed.
10. Invalid or illegally obtained Keys. Only keys purchased via MiningTools.net
or approved reseller may be used to unlock this software. Keys obtained via
other means constitute violation of the EULA and may result in termination
of all EULA agreements with MiningTools.net.
LIMITED WARRANTY
NO WARRANTIES. MiningTools.net expressly disclaims any warranty for
the SOFTWARE. The SOFTWARE and any related documentation is provided "as is"
without warranty of any kind, either express or implied, including, without
limitation, the implied warranties or merchantability, fitness for a particular
purpose, or no infringement. The entire risk arising out of use or performance
of the SOFTWARE remains with you.
NO LIABILITY FOR DAMAGES. In no event shall MiningTools.net or its suppliers
be liable for any damages whatsoever (including, without limitation, damages
for loss of business profits, business interruption, loss of business
information, or any other pecuniary loss) arising out of the use of or
inability to use this MiningTools.net SOFTWARE, even if MiningTools.net
has been advised of the possibility of such damages.
